1. Introduction

Thank you for choosing Rankchat. Protecting your privacy is important to us. This Privacy Policy explains how we collect, use, share, and protect your information when you use Rankchat, a software product operated by Iconic Tech LLC, a Wyoming limited liability company ("we," "us," or "our"). It should be read together with our Terms of Service, into which it is incorporated. By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy.

For personal data we process about you as our own customer or website visitor, Iconic Tech LLC acts as the "controller." Where you are a business customer and we process personal data contained in the data you submit to the Service on your behalf, we act as a "processor" and you act as the controller, as further described in Section 15.

2. Information We Collect

We collect the following categories of information to provide and improve the Service:

  • Identifiers. Your name, email address, account name, and similar identifiers.
  • Content and Connected Data. Information you provide or connect for the Service, including website URLs, Google Search Console data, content preferences, and other configuration you set up on our platform.
  • Prompts and AI Inputs and Outputs. The inputs, prompts, and connected data you submit for content generation, and the AI-Generated Content produced for you.
  • Commercial Information. Records relating to subscriptions purchased, considered, or obtained through our platform.
  • Payment Information. Your payment is handled by our third-party payment processor. We receive limited billing details (such as the outcome of a transaction and partial card information) but do not store your full payment card number.
  • Internet and Network Activity. Your interactions with the Service, device and log data such as IP address and browser type, and your communications with us.
  • Cookies and Tracking. We use cookies and similar technologies to operate and improve the Service and understand how it is used, as described in Section 12.

3. How We Use Your Information

We use your information to:

  • Provide, operate, maintain, secure, and improve the Service;
  • Generate SEO content for your website based on your connected data;
  • Understand and analyze how the Service is used and develop new features;
  • Process your subscription and payments;
  • Communicate with you about customer service, security, updates, and the Service;
  • Detect, prevent, and address fraud, abuse, and technical issues; and
  • Comply with legal obligations and enforce our Terms of Service.

4. Legal Bases for Processing (UK and EEA)

If you are located in the United Kingdom or the European Economic Area, we process your personal data on the following legal bases: (a) performance of a contract, to provide the Service you request; (b) our legitimate interests, such as securing, analyzing, and improving the Service and preventing fraud, provided these are not overridden by your rights; (c) your consent, where required, for example for certain cookies or marketing, which you may withdraw at any time; and (d) compliance with a legal obligation. Where we act as a processor for a business customer, that customer is responsible for establishing the legal basis for the underlying data.

5. AI Processing and Third-Party AI Providers

The Service uses artificial intelligence to generate content. To do this, your inputs, prompts, and connected website data may be transmitted to and processed by third-party AI model providers acting as our subprocessors, solely to generate content and provide the Service to you.

We do not use your content or connected data to train our own or any third party's generally available AI models. Where our AI providers offer such controls, we direct them not to use your data to train their models. Your inputs and connected data are used only to generate content and provide the Service to you.

You are responsible for ensuring you have the rights and permissions necessary to submit connected-site data and any third-party data to the Service.

6. Google User Data

When you connect Google Search Console, we access certain Google user data through Google APIs with your authorization, in order to analyze your site and generate content. Rankchat's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Specifically, we use Google user data only to provide and improve the Service's features you request; we do not use it for advertising; we do not sell it; we do not transfer it to others except as necessary to provide the Service, to comply with applicable law, or as part of a merger or acquisition; we do not use it to train generalized or standalone AI/ML models; and we do not allow humans to read it unless we have your consent, it is necessary for security or to comply with law, or the data is aggregated and anonymized. You can revoke our access at any time through your Google account security settings.

7. How We Share Your Information

We do not sell your personal information or your User Contributions. We share information only as follows:

  • Subprocessors and Service Providers. With third-party vendors that perform services for us or on our behalf, such as hosting, storage, payment processing, AI content generation, and analytics, as listed in Section 8.
  • Legal and Safety. When we believe disclosure is necessary to comply with a law, regulation, legal process, or governmental request; to enforce our Terms of Service; or to protect the rights, property, or safety of Rankchat, our users, or others.
  • Business Transfers. To a potential acquirer, successor, or assignee as part of a merger, acquisition, financing, sale of assets, or similar transaction, or in insolvency, bankruptcy, or receivership.
  • With Your Direction. To third parties you connect or authorize, such as content published to your own website.

8. Subprocessors

We use subprocessors to help provide the Service, including for hosting and infrastructure, database and storage, payment processing, AI content generation, product analytics, and connected data sources you authorize (such as Google Search Console). A current list of our subprocessors is available on request, and is included in our Data Processing Addendum for business customers. We require subprocessors to protect personal data consistent with this Privacy Policy and applicable law, and we may update our subprocessors from time to time as our providers change.

9. International Data Transfers

We are based in the United States, and your information may be processed and stored in the United States and in other countries where we or our subprocessors operate. These countries may have data protection laws that differ from those in your country. Where we transfer personal data from the UK or EEA to a country not deemed to provide an adequate level of protection, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum, or another lawful transfer mechanism.

10. Data Retention and Deletion

We retain your account information for as long as your account is active, and thereafter only as needed to comply with our legal obligations, resolve disputes, and enforce our agreements.

Account Cancellation. When you cancel your Rankchat account, the data associated with your account, including your website configurations, generated content, connected integrations, and personal information, is deleted from our active systems. Residual copies may persist in backups for a limited period before being overwritten.

Data Deletion Request. You may request deletion of your account and associated data at any time by contacting us at rankchat.ai@gmail.com. We will process your request and confirm deletion within 30 days, subject to retention required by law.

11. Your Privacy Rights

11.1 UK and EEA (GDPR). If you are in the UK or EEA, you have the right to access, correct, update, or delete your personal data; to restrict or object to certain processing; to data portability; and to withdraw consent where processing is based on consent. You also have the right to lodge a complaint with your local data protection authority, such as the UK Information Commissioner's Office.

11.2 California and Other US States. Depending on your state, you may have the right to know the personal information we collect, use, and disclose; to request access to or deletion of it; to correct it; and to opt out of "sale" or "sharing" of personal information. We do not sell your personal information. You will not be discriminated against for exercising these rights.

11.3 How to Exercise Your Rights. To exercise any of these rights, email us at rankchat.ai@gmail.com. We may need to verify your identity before responding. If you are a business customer, we will assist you in responding to requests from your own end users as described in Section 15.

12. Cookies and Tracking

We use cookies and similar technologies to keep you signed in, remember your preferences, operate the Service, and understand and improve how it is used. You can control or disable cookies through your browser settings, though some features may not function properly without them. Where required by law, we will request your consent for non-essential cookies.

13. Security

We use appropriate technical and organizational measures to protect your personal information against unauthorized or unlawful access, alteration, disclosure, and destruction. However, no security system is impenetrable, and we cannot guarantee the absolute security of our systems.

14. Children's Privacy

The Service is not directed to, and is not intended for use by, anyone under the age of 18, and we do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 18, we will delete it.

15. Business Customers and Data Processing

Where you use the Service as a business and submit personal data relating to your own customers or contacts, you are the controller of that data and we process it as your processor, solely to provide the Service and in accordance with your instructions, this Privacy Policy, and our Terms of Service. A Data Processing Addendum (DPA) covering such processing, including subprocessors and international transfer terms, is available on request at rankchat.ai@gmail.com. You are responsible for having an appropriate legal basis and any required notices or consents for the data you submit.

16. Third-Party Links

The Service may contain links to third-party websites or services that we do not own or control. We encourage you to review the privacy policies of any third-party websites or services you visit.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post any changes on this page and update the "Last Updated" date above, and if the changes are significant we will provide a more prominent notice.
